Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the MA Weight website (the "Service") operated by MA Weight ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Service Description

MA Weight is a free service that allows users to track their weight using exponential moving averages. The Service includes features for recording weight measurements, viewing trends through moving averages, and exporting data in CSV format.

2. User Registration

You may use the Service without creating an account. However, if you choose to create an account, you must provide accurate and complete information. You are responsible for maintaining the security of your account and for all activities that occur under your account.

3. Age Restriction

The Service is not intended for users under the age of 13. If you are under 13, you may not use the Service or provide any personal information to us. If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information.

4. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as detailed in our Privacy Policy.

5. Data Export

The Service allows you to export your weight data in CSV format. You retain full ownership of your personal data, and you may export and delete your data at any time. However, you grant us the right to store, process, and display your data as necessary to provide the Service.

6. Intellectual Property

The Service and its original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by MA Weight and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. The visual design, logos, and other distinctive brand features of MA Weight are protected by copyright and trademark law.

7. Prohibited Uses

You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation
• To attempt to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service
• To conduct automated data collection (scraping) without explicit prior written consent
• To transmit or facilitate the transmission of any malware, spyware, adware, or other malicious code
• To interfere with or disrupt other users' access to or enjoyment of the Service
• To impersonate or attempt to impersonate another user or person
• To violate the privacy or infringe the rights of others

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. This may occur if you:

• Violate any of the prohibited uses listed above
• Engage in any activity that disrupts or interferes with the Service
• Use the Service in a way that could harm other users or MA Weight
• Repeatedly violate these Terms or demonstrate a pattern of misuse

Upon termination, your right to use the Service will immediately cease. You may request an export of your data before account termination.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall MA Weight, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

10. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

MA Weight does not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements

The Service is not intended to provide medical advice. Any reliance you place on the Service is strictly at your own risk.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Service.
